INSTEC has proprietary cooling and shielding to protect DC and RF probes to enable higher temperature operation and uses a silicon carbide heater capable of heating in air. The acquisition is conducted under reduced competition due to urgency (see FAR6.302-2 and 13.106-1(b) and DFARS 206.302-2) or where the contracting officer is obligated by law to act more quickly than the MIAO nonavailability waiver determination review timeframes allow FAR 13.106(b)(1) sole source (b) Soliciting from a single source.  (1) For purchases not exceeding the simplified acquisition threshold.  (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
