Procurement Summary

The Department of Health and Human Services (HHS), National Institute of Health (NIH) and National Institute of Neurological Disorders and Stroke (NINDS) is requesting approval for an exception to the Buy American Statute (BA)) for the 4D Nucleofector Core Unit and 4D Nucleofector X Unit. Use of this device is industrystandard in transfecting cells. The need to introduce DNA into cells is vital to be able to study the function of proteins in cells. The objective is to introduce DNA into cells and then observe the impact of the protein that is produced. This device is needed to introduce DNA into cells that are difficult to transfect through traditional means. Such cells include neurons and glia, which are post-mitotic and have low transfection efficiency using traditional methods.

Waiver Rationale Summary

Based on the findings detailed above, it is determined that the 4D nucleofector core unit and 4D nucleofector X-unit are not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities and of a satisfactory quality. Therefore, it is hereby determined, consistent with [FAR 25.103(b) that these items are nonavailable.
