Procurement Summary
The Naval Surface Warfare Center, Philadelphia Division (NSWCPD) proposes to acquire and install one (1) non-commercial, custom-fit HX2 Replacement Temperature Control Valve. The existing temperature control valve is a Leslie Model 85 Direct Actuator 760E Valve Positioner and has experienced several reliability issues over the past years and is no longer supported by the vendor (obsolete). This effort is in support of the Compatibility Test Facility (CTF) under Contract No. N6449818C4002. The Statement of Work (SOW) specifies the procurement of a temperature control valve of the same form/fit/function as the one currently installed in the CTF River Water Cooling System. The Contractor, Rhoads Industries, procures material based on the Government-approved drawing bill of materials. The exact description of the valve to be procured states the following: Temperature Control Valve, 14" NPS, ASME B16.5 150# RF Flanges, 110/120VAC Actuator, 4-20mA Input and Output, Port Rotation of 1 to 3 with Failsafe Covering Port. Rhoads informed the Government that the only valve it could locate that meets our requirements is one that is manufactured and assembled in China, a nonqualifying country per DFARS 225.872-1.
Waiver Rationale Summary
As this acquisition is subject to 41 U.S.C. 8302, the Contractor is required to procure certain articles produced in the United States or a qualifying country. It was determined that the valve in question does not fall under any statutory exceptions. Market research has resulted in a finding that there are only two (2) vendors, Leslie (domestic, US made) and AMOT (non-domestic, non-qualifying country), that have manufactured a replacement valve with the same form/fit/function of the existing three-way rotary valve. No other domestically sourced 14” Temperature Control Valve was identified that meets CTF requirements to support the Motor Module Test Program (MMTP). The Leslie valve is no longer manufactured, as confirmed by Leslie Valve, the Original Equipment Manufacturer. The AMOT valve is supplied by AMOT Controls Group (Cage Code: 94607), which is manufactured in China, a nonqualifying country, is a true form/fit/function replacement for the installed Leslie valve, as confirmed by vendor drawings. The AMOT valve matches the existing piping and electrical interfaces, including control connections fed from the facility Test Plant Control Panel (TPCP).
