Waiver Rationale Summary

BSGI (KTR) has made extensive efforts to reach out to American manufacturers, including Lasko, Mathews Fans, Big Ass Fans, Birch LN, and several others. Unfortunately, most manufacturers do not offer a 48/52” white hugger-style fan. Many have shifted to producing more modern three-blade fans with larger housings, which range from 10 to 15 inches in diameter. Given the ceiling height requirements (with a minimum of 7 feet from the ceiling by code), the motor size becomes critical. In addition, most manufacturers recommend leaving at least 12 inches of clearance between the ceiling and the blades for optimal airflow. • Fan 1 shows a motor width of 10 inches, and the fan blades are not solid white as required. Fan cost is $877.59 each. • Fan 2 has a motor width of 9.25 inches, features a three-blade design, and includes a light kit that the customer specifically excluded. Price is $309.00 each. • Fan 3 – Meets specifications but is made in China Cost $140.00 each. • Fan 4 – Quorum also meets specifications but is made in China cost is $118.00 each. • Minka Aire is our proposed fan, which has a lowest point from the ceiling of 8.75 inches, no light kit, and a five-blade configuration. Cost is $119.00 each. (per Lowe’s and Home Depot websites) Given the project requirements for room size, square footage, and ceiling height, only Fan 3, Fan 4, or the Minka Aire fan will work for this application.” Due to the issues discussed above trying to meet the burden of the BAA clause – it is the opinion of this contracting officer to approve the requested waiver for the fans. In addition to the issues listed above, the proposed fans are COTS items and would satisfy the requirements of the SOW. Although the price/costs of these items are not a deciding factor for this waiver, it should be noted the COTS items will save the government a tremendous amount of money.
